EP314: The Islamic Approach to Dispute Resolution, With Larry Anthony of IAMS.LLC

I got the opportunity to revisit with Larry Anthony, JD, following our attendance at the Spring Conference of the ABA’s Dispute Resolution Section and our “LMIPodcast On the Road” video clip while in Chicago. Larry is a mediator at the Islamic Arbitration and Mediation Services (IAMS, LLC), which is based in Plano, Texas, just north of Dallas, but servicing parties in conflict around the world. Larry shared his unique journey into mediation and the specific nuances of Islamic dispute resolution.

Larry discussed the foundation of IAMS, which he co-founded with Imam Nadim Bashir. Their goal was to provide an alternative to litigation within the Islamic community, focusing on peaceful and faith-compliant resolutions. We delved into how Islamic principles intersect with legal practices, highlighting the surprising overlap in business matters and contracts. Larry also explained the key differences in family law, particularly regarding community property and divorce, where historical Islamic principles have influenced Western legal systems.

A topic of interest to me due to my former work at the Texas Office of the Attorney General Child Support Division, Larry also touched on child custody and support, emphasizing that while young children typically stay with their mothers, equal time with both parents is encouraged as they grow older. Child support, according to Islamic tradition, primarily falls under the father’s responsibility.

Larry clarified that IAMS operates within the framework of state laws, ensuring all mediated agreements are legally binding and enforceable.
